These Terms and Conditions govern your use of AgriTrader SA, accessible at https://agritrader.co.za. By accessing this platform, you agree to be bound by these terms in full. If you do not agree with any part of these terms, please do not use the platform.

1. About AgriTrader SA

AgriTrader SA is a specialized machinery exchange platform facilitating the trade of agricultural equipment, implements, and tools across South Africa. We are based in Heidelberg, Western Cape, and serve the national agricultural community.

AgriTrader SA operates as a listing and marketing service only. We are not a party to any transaction between buyers and sellers. We do not inspect, own, buy, sell, or hold any equipment on behalf of users.

2. User Responsibilities

By utilizing this platform, you warrant and agree to:

  • Provide verified, accurate, and current information in all listings.
  • List only machinery that you legally own or are strictly authorized to sell.
  • Ensure that all high-value machinery (tractors, harvesters, etc.) is described with accurate engine hours and service history where applicable.
  • Refrain from fraudulent activity, including the posting of non-existent equipment or “scam” pricing.
  • Interact with other traders in a professional and lawful manner.

3. Listings and Content Standards

All listings on AgriTrader SA are user-generated. We do not verify the mechanical condition, legal title, or accuracy of any item listed.

Listing Requirements:

  • Visual Representation: Listings must include actual photographs of the specific machinery being sold. Stock photos are prohibited.
  • Transparency: Descriptions must include known faults or required repairs.
  • Pricing: A genuine asking price must be provided. “POA” (Price on Application) is permitted only for high-value industrial assets.
  • Authority: AgriTrader SA reserves the right to remove, edit, or reject any listing that compromises the professional integrity of the exchange without prior notice.

4. Payments and Premium Featuring

AgriTrader SA provides both standard listings and Premium Featured Ads (R150).

  • Service Fees: Fees for featured placement are clearly displayed and are payable before the ad is promoted.
  • Transactions: Sale transactions for equipment are conducted independently of this platform. We do not handle or process funds related to the actual sale of machinery.
  • Security: All listing payments are processed through secure, POPIA-compliant third-party gateways. AgriTrader SA does not store or access your banking or card details.

5. Limitation of Liability

AgriTrader SA provides the infrastructure for an exchange but assumes no responsibility for:

  • The mechanical condition, safety, or legality of any machinery listed.
  • Financial losses, damages, or disputes arising from a transaction between users.
  • The conduct or identity of any buyer or seller.
  • Risk: Users transact entirely at their own risk. We strongly recommend professional mechanical inspections and secure payment methods for all equipment purchases.

6. Intellectual Property

The AgriTrader SA name, logo, provincial map interface, and proprietary design are the property of AgriTrader SA. By submitting content to the platform, you grant us a non-exclusive license to display and promote your listings across our national network.

7. Account Management and Termination

We reserve the right to suspend or permanently terminate access for any user who:

  • Violates these Terms or our Privacy Policy.
  • Engages in behavior that threatens the security or reputation of the exchange.
  • Attempts to manipulate platform features or bypass established listing protocols.

8. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
